The Biggest changes to Rental Laws in over 40 years Start on October 1st 2022

Hi everyone this is Simon Hornstra with link properties I wanted to check in today and talk about the biggest changes to Queensland rental laws in over 40 years to start on the 1st of October 2022.

Let's follow the changes, one of the biggest changes to tenancies is ending tenancies. Periodic leases will become effectively lifelong agreements, so that means that if you want to change your agreements you've got to do it before the 1st of October or you might get caught.

Without ground is no longer usable for ending a tenancy so you have to have a reason to end a tenancy and we can go over that in detail. Landlords face penalties for falsely evicting tenants, so it's important to make sure you're doing the right reasons otherwise you might get caught out.

Early Break Lease is if the tenant believes the property is not in working order as advertised they can terminate the lease within seven days of its starting, examples faulty dishwasher aircon or garage door, so make sure you've advertised the property correctly.

If the tenant believes the property was misrepresented in the advertising they can apply to QCAT within three months of the commencement of the lease to terminate the agreement. New repair rules coming in, a tenant can withhold up to four weeks rent for an emergency repair for example hot water system going or air conditioning. If a landlord does not comply with the requests a QCAT order can be made against the property. This can stop the property from being re-rented and could potentially stop the property from selling or being settled.

Minimum housing standards there is a large list of required works as of October 2022 which is due to increase in 2023 for the minimum standards for housing, unprepared landlords who don't keep up with the standards may be unable to re-tenant their properties until they can meet the standards.
